December 18, 2014 Asetek announced today that on Wednesday, December 17, 2014, a jury in the United States District Court for the Northern District of California unanimously ruled in favour of Asetek on all claims in its patent infringement suit against CMI USA, Inc. (CMI, formerly known as Cooler Master USA, Inc.).

The jury determined that, since 2012, CMI has been infringing Aseteks U.S. Patent No. 8,240,362. After trial began, CMI stipulated to infringement of Aseteks U.S Patent No. 8,245,764. The jury awarded Asetek damages of $404,941 (a royalty of 14.5%) based on CMIs infringing sales since 2012. The trial judge is expected to soon set a hearing on Aseteks request for an injunction against CMI.

Although it is frustrating to have spent significant time and resources in a courtroom, it is rewarding to be vindicated in this way,” said Andr Sloth Eriksen, Founder and CEO of Asetek. We appreciate the value of competition, but it must be done on equal terms. We will not accept anyone blatantly copying the patented solutions that we have worked so hard to bring into the market. He continues; Seen in the perspective of our future growth plans, especially in the data center segment, we cannot underestimate the significance of a solid portfolio of patents.

Asetek continues to litigate other patent infringement cases against CoolIT Systems and AVC (Asia Vital Components), which involve the same two Asetek patents as the CMI case. Asetek also continues to monitor the market for other infringement issues.
